This is easily entered with the<span style=\"color: #0000ff;\"><b>Judgment<\/b><\/span> link above. Interest can also be added on these amounts. Court fees can be added at the Origination date or later on, at any time in the resulting schedule.<\/li>\n<\/ul>\n<p align=\"center\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/margill.com\/images\/pre-judgment2.jpg\" alt=\"\" width=\"525\" height=\"366\" \/><\/p>\n<ul>\n<li>We compute and if the defendant pays according to schedule, 47 payments will be required to refund the judgment award that includes postjudgment simple interest; court fees (no interest) and prejudgment interest (no interest)<\/li>\n<li>There is also a second part to the judgment ($15,250) with interest starting only on 09\/17\/2009<\/li>\n<li>Various events included and updated over time: missed payments, partial payments, returned checks, fees (no interest) new Court fees ($1000)(see Line Status that reflects what is charged and when and the Comments column in the schedule)<\/li>\n<li>Starting 03\/01\/2010, we decide to recompute the equal payments to repay the total amount owed in 38 months.<\/li>\n<\/ul>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter\" src=\"https:\/\/margill.com\/images\/pre-judgment3.jpg\" alt=\"\" width=\"600\" height=\"455\" border=\"1\" \/><\/p>\n<p>Margill can include just about any repayment scenario however complex!<\/p>\n<p>Over 40 columns show what amount is paid when, all the while respecting the preset refund order:<\/p>\n<ol>\n<li>Interest on Court fees<\/li>\n<li>Interest on Prejudgment interest<\/li>\n<li>Interest on Other fees<\/li>\n<li>Interest on Principal<\/li>\n<li>Court fees<\/li>\n<li>Prejudgment interest<\/li>\n<li>Other fees<\/li>\n<li>Principal<\/li>\n<\/ol>\n<p align=\"center\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/margill.com\/images\/pre-judgment4.jpg\" alt=\"\" width=\"497\" height=\"323\" \/><\/p>\n<p>Some of the columns available when scrolling to the right<\/p>\n<p>The reports include the summary schedule as well as separate sections for Principal, Court fees, Prejudgment interest and Other fees.<\/p>\n<p align=\"center\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/margill.com\/images\/pre-judgment5.jpg\" alt=\"\" width=\"350\" height=\"189\" \/><\/p>\n<p><a name=\"4\"><\/a><\/p>\n<hr \/>\n<h2><b class=\"texteOrange\"><span style=\"font-size: small;\">Partial payments paid before the judgment<\/span><\/b><\/h2>\n<h3><b class=\"texteNoirSize2\">In our example :<\/b><\/h3>\n<p>$50,000 judgment in which the defendant has made 3 payments <b>before<\/b> the judgment. What is the total interest due at the judgment date?<\/p>\n<p>Use the Recurring payments (Amortization) calculation and Irregular payments. You will then be able to build your schedule. Simple or compound interest could be used. In this example, simple interest is used (Advanced icon).<\/p>\n<p align=\"center\"><img decoding=\"async\" src=\"https:\/\/margill.com\/images\/judgment4.gif\" alt=\"\" \/><\/p>\n<p align=\"left\">Three payments before judgment: January 10, 1999, June 26, 2000 and November 11, 2003.<\/p>\n<p align=\"left\">The judgment is pronounced on October 15, 2004. You must add each payment in the table (initially empty &#8211; &#8220;Period of Payments&#8221; being &#8220;Irregular&#8221;) to calculate the balance due and interest in the Results screen.<\/p>\n<p align=\"center\"><img decoding=\"async\" src=\"https:\/\/margill.com\/images\/judgment4a.gif\" alt=\"\" \/><\/p>\n<p>The judge may also decide to award various amounts at certain moments in time. In this case, insert <b>negative<\/b> amounts in the &#8220;Payment&#8221; column.<\/p>\n<p>In the example below, we will see how to calculate the interest if the defendant (now debtor) agrees to pay what is owed at $6000 per month.<\/p>\n<p><a name=\"5\"><\/a><\/p>\n<hr \/>\n<h2><b class=\"texteOrange\"><span style=\"font-size: small;\">Collection of judgment awards by recurring payments<\/span><\/b><\/h2>\n<p>The defendant owes the plaintiff $68,782.18 on the day of the judgment.<\/p>\n<p>Two approaches are possible:<\/p>\n<p>1) Continue the above calculation (nice and neat to have all in one calculation). In this case, since we are using simple interest, we must (may) add the accumulated interest on the judgment date. In our example, the debtor pays $6000 on the first of each month. These amounts, the payment frequencies and the interest rates can be changed. Also, if payments are missed, these can be added to the schedule and the table is recalculated.<\/p>\n<p align=\"center\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/margill.com\/images\/judgment5a.gif\" alt=\"\" width=\"503\" height=\"390\" border=\"1\" \/><\/p>\n<p>2) Make new payment schedule using $68,782.18 on the day of the judgment in the Recurring Payments (Amortization) calculation. The schedule can also be saved and edited.<\/p>\n<p><a name=\"6\"><\/a><\/p>\n<hr \/>\n<h2><b class=\"texteOrange\"><span style=\"font-size: small;\">Late \/ unpaid salaries indexed according to an agreement<\/span><\/b><\/h2>\n<p>Use the &#8220;Accrual by installment calculation&#8221;. See the <a href=\"\/en\/late-unpaid-salaries-rent-or-alimony\/\"><b>Late \/ unpaid Salaries, Rent, Alimony<\/b><\/a> page.<\/p>\n<p><a name=\"8\"><\/a><\/p>\n<hr \/>\n<h2><b class=\"texteOrange\"><span style=\"font-size: small;\">Hypothesis of a lump sum to be paid to the plaintiff instead of a structured settlement over time<\/span><\/b><\/h2>\n<p>This is a fictional example with more or less arbitrary numbers to demonstrate how Margill can help:<\/p>\n<p>The plaintiff (20 years old) was seriously injured as a student in university. He will not be able to work for the rest of his life. What lump sum should be paid today instead of a structured settlement, taking into account his revenue today as a student, as a worker and upon retirement?<\/p>\n<ul>\n<li>Revenue as a student is estimated at $1000 per month (for 2 years)<\/li>\n<li>As a worker, his salary would be $50 000 a year ($4167 per month). This amount is indexed at 2.0% per year up until 65 (for 33 years)<\/li>\n<li>Upon retirement the yearly revenue falls to 30 000$ in today dollars but indexed at 2.0% per year (10 years). $30,000 in 35 years would be worth approx. $57 600 with 2% yearly inflation.
